§1 Information on the Collection of Personal Data and Identification of the Vendor

  1. We are informing you hereafter about the collection of personal information when using this website. Personal data are any data that can be personally associated with you, e.g. name, address, e-mail addresses, user behavior.
  2. The Data Controller, pursuant to Article 4, Sec. 7 EU General Data Protection Regulation (GDPR), is Delta Port GmbH & Co. KG, Moltkestr. 8, 46483 Wesel, Germany, info@deltaport.de (see our imprint). Our Data Protection Officer is Mr. Andreas Pinheiro LL.M., a.pinheiro@ap-datenschutz.de.
  3. In case we have to rely upon subcontracting third party service providers for any of our service offerings, or if we want to use your data for advertising purposes, we will inform you below in detail about the individual processes. In doing so, we will also advise the defined criteria of storage duration.

§2 Your Rights – Including, But Not Limited to Information and Revocation

  1. You have the following rights against us in respect to the personal data concerning you:
    –    The right to information,
    –    The right to correction or deletion,
    –    The right to limitation of processing,
    –    The right to object to the processing,
    –    The right to data portability.
  2. If you have given consent to the use of data, you may revoke such consent at any time. If it is lawful to process data based on a consent, such consent shall remain in effect until a revocation is exercised.
  3. Please send any requests for information, clarification, or statements of revocation in connection with data processing concerns by e-mail to info@deltaport.de or to the address mentioned in § 1, sec. 2.
  4. You may request at any time that we delete your data. The law may provide for retention periods that entitle us to store your data up to the end of such period.
  5. If your data are incorrect, you have the right to request a correction from us. We will promptly comply with such request.
  6. You have the right to obtain from us the provided personal data in a readable format, as far as technically feasible, so that they can be made available to another company (right to data portability).
  7. You have the right to complain to your competent regulatory authority.

§3 Data Security

  1. We maintain up-to-date technical measures to warrant data security, particularly in respect of protecting your personal data from dangers during data transfers and to keep third parties from gaining knowledge of such data. We continue to adapt these measures to the current state-of-the-art.

§4 Collecting Personal Data During Informational Usage of the Website and Establishing Contact

  1. During merely informational usage of the website, i.e. if you do not register or provide information to us otherwise, collection of data is limited to those personal data that your browser transfers to our server. When you visit our website, we collect the following data, which are technically necessary for us to show you our website and to warrant stability and security (legal basis is Art. 6, Para. 1, S. 1, Letter f GDPR):

    –    Date and time of request
    –    Time zone difference to Greenwich Mean Time (GMT)
    –    The content of the request (specific page)
    –    Access status/HTTP status code
    –    The individual amount of data transferred

  2. When you contact us by E-mail or via the contact form, your e-mail address and your name will be stored by us. The storage occurs merely for the purpose of contacting you to answer your questions.
  3. Legal basis for the specified collection is the consent you gave by visiting our website and by confirming the cookie banner (Art. 6, Para. 1, Letter a GDPR).
  4. We will use your information only for the purposes of advertising to the extent permitted by law. We particularly use your e-mail address merely for direct marketing for similar goods or services of our own. You may object to the use of your data for advertising purposes at any time in writing or in text form (e-mail to info@deltaport.de). Within this context we refer to our legitimate interest in advertising our products towards our customers pursuant to Art. 6, Para. 1, Letter f GDPR.
  5. In addition to the above-mentioned data, cookies are stored on your computer during your visit to our website. Cookies are small text files that will be stored in a correlated manner on your hard disk with the browser you are using. Cookies convey certain information to the body that sets the cookie (in this case that is us). Cookies cannot execute programs or deliver viruses to your computer. Their purpose is to make the overall internet experience more user-friendly and efficient.

§5 Cookies

  1. We use cookies on our website. Such cookies are necessary so that you can move about freely on the website and utilize its features, including for instance access to secure areas of the site. Through the use of cookies, we can know who has visited the page(s), and derive from this, how frequently particular pages are visited, or which parts of the site are especially popular. Session cookies store information about your activities on our website.

§6 Dissemination of Data for Website Maintenance Purposes

  1. We will not pass your personal data on to third parties, unless we inform you about such a dissemination.
  2. Our IT service providers have access to our stored data to correct errors and to enable us to perform the required technical and organizational measures. Within this context we refer to our legitimate interest in securing our IT pursuant to Art. 6, Para. 1, Letter f GDPR and/or to the need to comply with legal obligations under Art. 6, Para. 1, Letter c GDPR.
  3. The IT service provider(s) has/have been carefully selected by us and commissioned in writing. They must follow our instructions and are regularly inspected by us. The service providers will not pass these data on to third parties.
  4. A transfer of your data outside of the EU (EEA)-space does not take place.

§7 Social Media Plug-Ins

  1. We currently use the following social media plug-ins: Facebook, Twitter. Here we are using the so-called two-click solution. This means that when you visit our site, generally no personal data are initially disseminated to the provider of the plug-ins. You can recognize the provider of the plug-in by the mark on the box above their initials or by the logo. Via the button, we give you the opportunity to communicate directly with the provider of the plug-in. Only when you click on the highlighted field and thus activate it, the plug-in provider will receive the information that you have accessed the corresponding website of our online offering. In addition, the data referred to in § 2 of this statement will be transmitted. In the case of Facebook and Xing, according to the statements of the respective provider in Germany, the IP address is made anonymous immediately after collection. That means that by activating the plug-in, your personal data are transmitted to the respective plug-in provider and stored there (in the case of U.S. providers the location will be in the United States). Since one of the main methods of collecting data is through the use of cookies, we recommend that you update the security settings of your browser to delete all cookies, before clicking on the grayed-out box.
  2. We have no influence on the data collected and data processing activities, nor are we aware of the full extent of the data collection, the purpose of the processing or the storage periods. Furthermore, we have no information of the data collected by the plug-in provider.
  3. The plug-in provider stores the data collected about you and uses them as usage profiles for purposes of advertising, market research and/or demand-oriented design of their website. Such an evaluation is in particular performed (also for non-logged in users) for the display of demand-oriented advertising and to inform other users of the social network about your activities on our website. You have a right to object against the formation of these user profiles, but in order to exercise this right, you must contact each respective plug-in provider. Using the plug-ins, we offer you the opportunity to interact with the social networks and other users so that we can improve our offering and make it more appealing for you as a user.   4. The transfer of data happens regardless of whether you have an account with the plug-in provider and are logged in there. If you are logged in at the plug-in provider, the data collected on our site are directly correlated to your existing account at the plug-in provider. If you engage the activated button and link to the page, for example, the plug-in provider also saves this information in your user account and may communicate that information openly with your contacts. We recommend that you log out after using a social network on a regular basis, but in particular before activating the button, this way you can avoid a correlation to your profile with the plug-in provider.

§8 Web tracking – Google Analytics

  1. This website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses so-called “cookies”, i.e. text files that are stored on your computer and that enable an analysis of your use of the website (see § 5). The information generated by the cookie about your use of this site are generally sent to a Google server in the USA and stored there. In the case of activation of the IP anonymization on this website, Google will truncate your IP address within member states of the European Union or in other signatory states to the European Economic Area Treaty prior to transmission. Only as a matter of exception, the full IP address is transferred to a Google server in the USA and truncated there. §10 YouTube

  1. We have embedded YouTube videos into our website, which are stored at http://www.YouTube.com and can be played directly from our website. These are all embedded in the “advanced privacy mode”, which means that no data about you as a user are uploaded to YouTube when you do not play the videos. Only when you play the videos, the transfer of data specified in § 2 will occur. We have no influence on this data transfer.
  2. By visiting the website, YouTube receives the information that you have called up the corresponding sub-page of our website. In addition, the data referred to in § 2 of this statement will be transmitted. This occurs independent from whether or not YouTube provides a user account that you are logged into or whether or not there is a user account at all.
